Gym Participation Waiver

To register to our gym please fill out the following form:

Photo Release: I give my permission to have any pictures or videos of my child or myself used on Trick Dynamix’s website and or promotional materials. 

In consideration of being allowed to participate in sports programs at Trick Dynamix/Phoenix All-stars, or any other related events and activities, the undersigned acknowledges, appreciates, and agrees that:

 

  1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist.

  2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of staff employees, agents, and representatives of Trick Dynamix/Phoenix All-Stars, or others and assume full responsibility for my participation or that of my minor child or ward for whom I am signing for as legal guardian of a minor.

  3. I willingly agree to comply with the stated and customary terms and conditions for participation. If however, I observe any unusual significant hazard during my presence or participation, I may remove myself or a minor who I have signed for from participation and bring such to the immediate attention of nearest staff employee>

  4. I, for myself, or my minor child/ward and on behalf of my heirs, assigned, personal representatives and next of kin, hereby release and hold harmless Trick Dynamix/Phoenix All-Stars. Their officers, staff employees, agents, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of said premise used to conduct the event, (collectively the releases). With respect to any and all injury disability, death or loss or damage to person or property, whether arises from the negligence of the releases or otherwise.

  5. This is to certify that I, with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the releases, and, for myself,  any heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the releases from any and all liabilities incident to the involvement or participation of my minor child in these programs as provided above, I agree to this even if injury or death arises from the negligence of the releases. This release is absolute and to the fullest extent permitted by law. I further certify that I have health insurance coverage on myself, or my minor child/ward, and the coverage will remaining in full force and effect during the period I, or my child/ward remains enrolled with Trick Dynamix/Phoenix All-Stars, I understand that the failure of Trick Dynamix/Phoenix All-Stars to verify this information does not waive my responsibility to comply.

 

I have read this release of liability and assumption of risk agreement, I fully understand the terms, understand that I have given up substantial rights by signing this waiver, and sign freely and voluntarily without any inducement.

COVID-19 Waiver

The coronavirus, Covid-19, has been declared a worldwide pandemic by the World Health Organization. Covid19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Trick Dynamix/East Celebrity Elite/Phoenix All Stars, LLC (whereas now referred to as “ECE”) has put in place preventative measures to reduce the spread of Covid-19, however, Trick Dynamix/ECE cannot guarantee that you or your child(ren) will not become infected with Covid-19. Further, attending Trick Dynamix/ECE could increase your risk and your child(ren)’s risk of contracting Covid-19. By signing this agreement, I acknowledge the contagious nature of Covid-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by Covid-19 by attending Trick Dynamix/ECE and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by Covid-19 at Trick Dynamix/ECE may result from the actions, omissions, or negligence of myself and others, including, but not limited to Trick Dynamix/ECE employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Trick Dynamix/ECE or participation in Trick Dynamix/ECE programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of a relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence Trick Dynamix/ECE, its employees, agents, and representatives, whether a Covid-19 infection occurs before, during, or after participation in any Trick Dynamix/ECE program. Athlete and Guardian agree to abide by the following guidelines:

1.    Athlete will NOT come to the gym if they have a temperature or do not feel well in anyway.

2.    Temperatures will be taken at the door.  A temperature of 100 or above will not be permitted in the gym. 

3.    Each athlete will be required to bring their own water bottle to drink. Water fountain is closed. 

4.    Guardians agree to discuss social distancing with your athlete prior to every practice, private lesson or class. 

5.    When an athlete goes to the bathroom, they must wear shoes (flip flops or slides kept in the designated areas) 

6.    Correct hand washing or hand sanitizing will be done before and after each practice, private lesson or class. 

7.    Athlete will not arrive more than 10 minutes prior to practice starting. 

8.    Parents will pick up promptly on time. 

9.    Proper social distancing practices will be adhered to at home. 

10.  All participants must wear a mask when training.

By signing below, I certify that I/my child does not have any flu like symptoms now and if in the future symptoms appear, I agree that I/my child will stay home.

By signing below, I certify that I/my child has not been with anyone that has been sick with Covid-19 or flu like symptoms.

By signing below, I certify that I/my child has not traveled within the last 14 days.

Open Gym FYI

*Kids ages 14 and under must have had at least 1 lesson with TDX, to attend open gym*

*Masks must be worn at all times, unless fully vaccinated.
